Residence permit renewal in Spain in 2026: deadlines, documents and status changes
🕗 9 min read · Updated October 15, 2026
Your first residence permit expires after one, two or three years. At that point you face a choice: renew your current status or switch to a different one. Employers change, income changes, families grow, and the old permit no longer fits your new life.

This guide walks you through renewal step by step: deadlines, documents, the mistakes that lead to refusals, and how to switch between statuses without losing the years you need for permanent residence.

Renew, modify or apply again?

Spanish immigration law gives you three ways to stay in the country when your card is about to expire.

Renovación. You renew the same status on the same grounds.
Modificación. You convert your current status into another one without leaving Spain.
Solicitud inicial. While you stay in Spain legally, you file a new application for a different status.

The key question is not “how do I renew my permit” but “which status works best for me now”. Sometimes renewal is the best move. Sometimes your current permit has done its job, and it is time to move on.

Advice from Alina Kaba, founder of Dreamlife Spain
Don’t rescue your old permit on autopilot. Each time, choose the next best status. Compare statuses on three criteria: validity period, right to work and taxes.

Renewal filing deadlines

The immigration office accepts a renovación application from 60 days before your card expires and up to 90 days after.

We recommend filing only in the “before” window, while your residence permit is still valid. Keep the “after” window as a last-resort backup.

If you file on time, you stay in Spain legally until the office decides on your application.
Warning: the “after” window is not a strategy
Filing after expiry can lead to a fine. If you miss the 90 days after as well, you will have to restore your status through a new procedure.

Renewal as an exam: documents and proof

Residence permit renewal deadlines in Spain
The Extranjería officer checks two things: whether you meet the requirements today and whether you met them during the whole previous period. Start preparing for renewal on the day you receive your card.

Renewal folder: your folder of proof
Create a folder and keep adding to it while your permit is valid. The exact contents depend on your status. The basic set:
• passport and valid TIE card
• EX application form and the paid fee (form 790)
• proof of income or funds for the whole period
• health insurance with no gaps
• padrón and rental contract
• tax returns, if you are a Spanish tax resident
Tell a story instead of uploading 25 files
A strong application reads like a case history. Arrange your documents in this order:
a) what you had before
b) what has changed
c) why you still meet the conditions of your permit
d) which document proves what
Digital Nomad renewal: contract and bank statements
Your contract shows how much you should earn. Your bank statements show that the money arrived. A contract alone will not renew a digital nomad visa: you need incoming payments to your account for the whole period.
Important: check the fecha de efectos
Check the effective date in your renewal resolution. There must be no gap between your first permit and the renewal. Fix any date error right away, or your next application will count as late.

Four questions before you change status

Life itself gives you reasons to change your permit: losing a job, a divorce, income below the threshold. The main rule of any switch: never fall out of legal status along the way. Before you decide, answer four questions:

a) Am I renewing my current status or do I want a different one?
b) Can I use modificación, or do I need a new solicitud inicial?
c) Have I held residencia for at least one year?
d) Does my current status allow me to work?

Your answers set the route, the timeline and the document package.
The one-year rule

If your current permit allows you to work and you have held residencia for at least a year, Article 191.3 of the Regulation sends you to the renewal requirements for cuenta ajena or cuenta propia (Articles 80 and 86), not to the requirements for a first permit. The new status is valid for 4 years. It lets you work as an employee or self-employed with no limits on region or sector.
Switching after a change in circumstances

Criterio 1/2025 allowed holders of Ley 14/2013 permits (Digital Nomad, HQP, entrepreneurs) to move to the general regime through Article 191. Extranjería and the UGE then agree on ending the old status.
Warning: three-month deadline
File for modificación within three months of the change in your circumstances. Wanting a different permit does not count as grounds: you need a change that prevents you from keeping your current permit.

Popular switches between residence permits

Switching from Digital Nomad to cuenta propia

To switch to self-employment, you need a business plan, which goes out for an official review, and an active autónomo registration. Each province asks for its own set of documents and works to its own processing times.

Processing times by region

Switching to cuenta propia. Based on Dreamlife Spain lawyers’ cases as of October 2026, not official statistics.
  • Cantabria
    5–6 days
No UGE notice and no business plan approval.
  • Tarragona
    2 days to 2 weeks
No business plan and no vivienda adecuada. Families need a collective padrón
  • Málaga
    1–4 weeks
Flexible about gaps in social security contributions
  • Asturias
    2–4 weeks
Requires vivienda adecuada for family members
  • Castellón and Granada
    1–2 months
Castellón does not require a UGE notice
  • Galicia
    2–3 months
  • Tenerife and Alicante
    about 3 months
  • Barcelona and Madrid
    3–5 months
    A UGE notice is required
  • Valencia
    from 5 months
2–3 requests for extra documents, UGE notice
Registering an address just for speed will not work. Your move and registration in the new province must be real.
Life in Spain after renewing your residence permit

Renewal refused: your options

A refusal does not close the door. Your options: apply again, appeal, choose another type of permit, or file a new application through arraigo. If you cannot renew your status, file a first-time application while you are still in Spain.

Five types of arraigo under the new regulation
• social: about two years of living in Spain, plus a job contract or your own funds
• sociolaboral: for people who have a job
• socioformativo: for people in official study programmes, with part-time work up to 30 hours a week
• familiar: for people with family in Spain
• de segunda oportunidad: for people refused a renewal because of an error on the Spanish side

The time you lived in Spain on another legal basis, such as study, counts toward arraigo. Choosing the wrong type of arraigo costs months of waiting, so plan your route with a lawyer.

How renewal affects permanent residence and citizenship

Keep two counters. “My permit” shows the date your status expires and what you need to do. “My 5 years” shows how much time you have built up toward residencia de larga duración.

• a renewal with no gap keeps your residence record
• a modificación inside Spain keeps your residence continuous
• going home and reapplying through a consulate can break the chain
• a period without legal status usually resets your continuity
• time on student status counts differently from other residence permits
• time under temporary protection may count
Case study: a family swaps roles
The spouses swapped roles: the main applicant became the family member, and the other spouse became the main applicant. We filed it as an inicial application, not as a renewal. The result: a 3-year permit instead of 2, with the residence record for permanent residence intact. We submitted the package to the UGE on August 15, and approval came on September 10 with no requests for extra documents.

The path to Spanish citizenship

Everything we covered today, renewals, switches, arraigo, serves one goal: turning your years in Spain into citizenship. Now you will see why I keep talking about continuity and the two counters.

How many years until citizenship

  • 1 year
For people married to a Spanish citizen, and for children in the cases the law provides
  • 2 years
For citizens of Latin American countries
  • 10 years
    For everyone else
The key word here is “continuous”
These years must be legal, consecutive and right before you apply. Not “I lived in Spain at some point”, but year after year on a valid residence permit.
Permanent residence and citizenship are not the same thing. Permanent residence, or long-term residence (larga duración), opens after 5 years. Citizenship, for most people, after 10. Many people mix these up and worry that “I have permanent residence but no passport”. That is normal: these are two different steps on the same path.

What counts in these years. Time on a residence permit: Digital Nomad, Non-Lucrative, cuenta propia, cuenta ajena, HQP, arraigo.

Time on student status (estancia por estudios), however, does not count toward citizenship: courts treat a “stay” and a “residence” as different things. That is why I always tell students to move from study to a residence permit as early as they can, or those years will be lost for citizenship.
Warning: what breaks the counter
  • a period without legal status: this is why everything we said about renewing before expiry is not bureaucracy but protection for your years;
  • going home and applying again, which breaks the chain;
  • absences from Spain that last too long.

Exams and costs

  • CCSE
    about 85 €
An exam on Spanish culture, law and society. Mandatory
  • DELE A2
    110–220 €
Basic-level Spanish. Required if Spanish is not your native language. The price depends on the exam centre
  • Fee
    about 104 €
The government fee for processing your application
Important news: the PP party proposes raising the language requirement to B2 in its programme. Keep in mind that this is a party programme, not a law.

How to apply. You file the application online with the Ministry of Justice. You will need:
  • birth certificate;
  • criminal record certificates with an apostille and translation;
  • valid residence card and padrón;
  • exam certificates.
By law, processing takes one year; in practice it takes one year to eighteen months. If you get no answer within a year, the application counts as refused through administrative silence. After a positive decision, you must take the oath within the set deadline, register your citizenship, and only then get your Spanish documents.
What happens to my current citizenship?
Spain does not recognise dual citizenship for everyone. Most nationals must renounce their previous citizenship at the oath, while citizens of Latin American countries and a few others do not have to. Check your home country’s laws before you apply. You cannot leave this decision to the last stage.

Let’s sum it up

  • 01
A residence permit is a path, not a finish line.
Choose not only your entry point but also your next step.
  • 02
    Renewal is an exam.
Build your renewal folder in advance, tell the story of your case, file before expiry.
  • 03
When conditions change, change the strategy.
Job loss, divorce, savings running low, a new job: each time, ask yourself the four questions.
  • 04
Don’t save your old permit at any cost.
    Choose the next best status.
  • 05
Almost every situation has a legal way out.
But you need to choose it with precision and speed.
  • 06
Citizenship is the finish of a 10-year marathon.
Test every decision with one question: what does it do to my years?
